Jaipur, sept 10 (udaipur kiran): The Rajasthan High Court has stayed proceedings on an FIR filed against Bollywood actors Shah Rukh Khan and Deepika Padukone in connection with allegations of marketing a defective car. The case was registered at Mathura Gate police station in Bharatpur.
The order was passed by a single bench of Justice Sudesh Bansal during the initial hearing of a criminal petition filed by the actors and others.
Appearing for the petitioners, senior advocate Kapil Sibal argued that the complainant had used the car for nearly three years, covering 67,000 kmbefore filing the FIR. He contended that:
No specific allegations were made against the actors, who had merely endorsed the car in advertisements.
Vehicle performance depends on usage, and even if the complainant had issues with the car’s performance, it did not constitute a criminal offence.
The proper remedy lay before a consumer courtnot through filing an FIR.
After hearing the submissions, the High Court directed a stay on further action in the FIR against the actors and others.
The FIR, lodged by advocate Kirti Singh of Bharatpurnamed the company’s MD Anso Kim, Director and CEO Tarun Gargalong with Shah Rukh Khan and Deepika Padukone.
The complainant alleged that he purchased the car in Cive 2022 for ₹23.97 lakh. While driving on highways, the vehicle allegedly failed to pick up speed during overtaking, displayed a “malfunction” warning on the odometer, and vibrated at higher speeds.
He further claimed that the dealership acknowledged a manufacturing defectmaking both company representatives and the celebrity endorsers equally liable.
The matter will now be heard further by the High Court.
