Samay Raina: Comedian Samay Raina has received a major relief from the Supreme Court in the case of his alleged insensitive comments about disabled persons on the show India’s Got Latent. The Supreme Court has quashed all the FIRs registered against Samaya Raina in different parts of the country and also ordered to stop the proceedings against him. Chief Justice of India Suryakant, Justice Joymalya Bagchi and Justice V. Mohanani bench gave an order in this matter. The court noted that Samaya Raina and others have followed the directions given earlier by the Supreme Court to hold awareness programs and raise funds for the differently-abled.


Relief to others besides Samay Raina


In this case not only Samaya Raina but also some other people have been given relief. They include Vipul Goyal, Balraj Paramjit Singh Ghai, Sonali Thakkar aka Sonali Aditya Desai and Nishant Jagdish Tanwar. India’s Got Latent show was criticized for some of its comments about persons with disabilities. Subsequently, FIRs were registered against the concerned people in different parts of the country.


The Supreme Court appreciated the efforts


The Supreme Court also praised people including Samaya Raina for organizing programs for the disabled and raising funds for them. The Court observed that when a serious effort is made in the right direction it also yields good results. The bench termed these youth as talented and said that if they use their potential in the right direction, it can yield positive results.


All FIRs quashed, but the matter will continue to be heard


Even though the FIR and criminal proceedings against Samaya Raina and others have been quashed, the Supreme Court will continue to hear the wider issue to this.


The court will now consider suggestions from persons with disabilities and concerned parties on how such content can be more effectively monitored. Courts can also give appropriate directions as to what kind of guidelines or regulations are necessary to prevent future situations in which the disabled community is insulted or broadcast of insensitive content. The ruling provides a major legal relief for Samaya Raina personally, but also re-opens the issue of balance between freedom of expression in online and entertainment content and responsibility to vulnerable communities.
