New Delhi: The Supreme Court will hear the PIL filed against Chief Election Commissioner Gyanesh Kumar on October 27. In this matter, the court has issued notice to the Central Government, Election Commission and Chief Election Commissioner. The court had passed an order in this regard on Tuesday. Earlier on Monday, the Supreme Court had said that it will investigate all the decisions of the Election Commission and if any decision is found not to be in accordance with the law, it will be cancelled. This comment was made by a bench headed by Chief Justice of India Surya Kant during the hearing of petitions alleging that the Election Commission has taken several decisions without the approval of both the Election Commissioners.
CJI Surya Kant's bench also clarified that the Supreme Court has not approved any changes in Form 6 being used during SIR. The bench said that when the complete records come out, it will be seen who made the changes in Form 6 and how. It is noteworthy that only through Form 6, an eligible person applies to get his name added to the voter list.
Senior advocate Vikas Singh, appearing for petitioner Rakesh Kumar Singh, had demanded that Chief Election Commissioner Gyanesh Kumar be stopped from taking any decision till the final decision is taken and he should be suspended. The court refused to impose an interim stay on this. The CJI said that the court cannot give such an order only on the basis of newspaper reports, it will first have to see the response of the Election Commission and the Central Government.
The court also said that if the CEC is suspended then the entire work of the Election Commission will come to a standstill. The bench asked who would then conduct the elections. On this, the petitioner side said that both the Election Commissioners can handle the work, but the court has not accepted this argument at the moment. Now the next hearing of this case will be on October 27, in which the Center and the Election Commission will have to present their side.
