Mumbai Bombay High Court has given new instructions in the matter of notice issued to actor Imran Khan to leave India. The court has also asked to make Maharashtra Government a party in the petition. During the hearing held on Monday, the court fixed the next hearing of the case on October 26. The actor has challenged the 'Leave India Notice' issued by the Mumbai-based Foreigners Regional Registration Officer (FRRO). In this notice, he has been instructed to leave India by 28 October.
According to the information, this notice was issued to Imran Khan on October 14. It is alleged that he had participated in a protest organized at August Kranti Maidan in Mumbai on October 10. During this time he was detained. After this, the actor, who holds American citizenship, was given a notice to leave India.
On Monday, the actor's senior lawyer Venkatesh Dhond mentioned the petition before a bench of Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna and sought urgent hearing. He argued that Imran Khan has been instructed to leave the country by October 28, hence an early decision on the matter is necessary.
On behalf of the actor, the court will demand an interim stay on the notice. His petition has requested for cancellation of the notice as a final relief. The court also directed the Maharashtra government to be made a party in the case and scheduled the next hearing for October 26.
Senior lawyer Venkatesh Dhond, appearing for Imran Khan in the court, said that his client has no criminal history or record. “This is a petition in which a person, who has been living in India since the age of two, has been asked to leave the country without any notice, without any hearing and without giving any reason,” he argued.
In the actor's petition, questions have been raised on the process of issuing the notice. He wants immediate relief on this order from the court.
During the hearing, Additional Solicitor General Anil Singh, appearing for the Central Government, sought time to file the reply. He told that he had received the copy of the petition only on Monday morning. After this, the court fixed October 26 for the hearing of the case and directed the Maharashtra government to also be made a party.
Imran Khan currently has American citizenship. According to the news, he has been trying to get an Indian passport for the last 15 years, but till now he has not been able to get the passport.
Now the next hearing in the case will be on October 26. In this, the actor will demand an interim stay on 'Leave India Notice'. It will also be decided in the court as to how the petition challenging the notice will be heard further.
